We were thinking the exact thing a second ago:
Though somewhat dated, John Noonan’s “A Private Choice” provides a very helpful overview of what’s at stake in battles over court nominees. For Noonan, the question is not one of politics, but worldview, in this case, the clash between traditional American jurisprudence and that of Hans Kelsen.
